Beijing IP court confirms infringement by Everlight’s subsidiary and distributors and orders to pay RMB 3.2 million to Nichia

On January 10, 2019, the Beijing Intellectual Property Court issued three judgements, holding that Everlight Electronics (China) Co., Ltd. ("Everlight China") and its distributors have infringed Nichia’s Chinese Patent No. 97196762.8 (“YAG patent”). The judgments were results of the lawsuits that Nichia filed in March 2016.

In two judgments, the court ordered Everlight China to compensate Nichia for damages of RMB 1 million, reaching the maximum limitation of Chinese statutory damage, as well as for reasonable expenses of RMB 250,000. In one judgment, in which only the distributors were listed as defendants, the court ordered the distributors to compensate Nichia for damages of RMB 500,000 as well as for reasonable expenses of RMB 200,000. In conclusion, Everlight China and distributors are ordered to compensate Nichia in the amount of RMB 3.2 million.

The three judgements issued by the Beijing Intellectual Property Court concern white LED products with model numbers of 67-21UMC/S3031/TR8/LT, 334-15/T1C1-4VXC-L (ES), and 67-21S/KK2C-H6565M41N42936Z6/2T.

Further, Nichia also successfully secured the victory with the Beijing Intellectual Property Court to affirm the validity of the YAG patent at the end of 2018. This again confirms the validity of the YAG patent in China.
