Beijing No.1 Intermediate People's Court Upholds the Validity of Nichia's YAG Principal Patent Against Everlight's Challenge

On October 22, 2013, Nichia Corporation (“Nichia”) received the written judgment of the Beijing No.1 Intermediate People’s Court. This judgment is related to the previous decision in which the Patent Reexamination Board, which is under the direct supervision of the SIPO of China, held that Nichia’s Chinese patents ZL97196762.8 and ZL03159595.2 (hereinafter collectively called “Nichia’s YAG patents”) are valid. A Taiwanese LED manufacturer, Everlight Electronics Co., Ltd. (“Everlight”), appealed to the Beijing No.1 Intermediate People’s Court, and requested that the decision be dismissed. According to the judgment by the Beijing No.1 Intermediate People’s Court, the court dismissed all of Everlight’s requests and affirmed the decision of the Patent Reexamination Board in which the board held that Nichia’s YAG patents are valid.
