Warning Letter to HARVATEK Co.
February 16, 2006 - Nichia Corporation announced today that Nichia alerted a Taiwanese LED manufacturer HARVATEK CORPORATION of its infringement on Nichiafs design patent (Taiwanese Patent Certificate No.089,036) by a warning letter.
Nichia entrusted a Taiwanese expert to assess whether the LED (HT-V135BP) distributed by HARVATEK infringes the abovementioned Nichiafs design patent, and then sent HARVATEK a warning letter based on a patent infringement assessment report (click here for a summary of the report) saying that the abovementioned LED infringes the abovementioned Nichiafs design patent.
The asserted design patent is one of Nichiafs patents concerning SMD Type LED. The disputed LED corresponding to this design patent is mainly used as the backlight of the liquid crystal display of cellular phones. Nichia holds design patents for this SMD Type LED in several countries including Taiwan.
Nichia will take necessary measure to protect its intellectual property rights against any companies in any part of the world.
