Nichia Won Invalidation Proceeding against Everlight’s Patent in China and Corresponding Infringement Lawsuits were Withdrawn by Everlight

On June 27, 2019, in a patent invalidation request filed by Nichia against Chinese patent ZL200710161547.X (“’547 Patent”) in relation to flip-chip technology owned by Everlight Electronics (China) Co., Ltd. (“Everlight”), China National Intellectual Property Administration (“CNIPA”) rendered a decision entirely affirming Nichia’s requests and invalidated ‘547 Patent (docket numbers: 4W108258). After the CNIPA’s decision, infringement lawsuits concerning ‘547 Patent filed by Everlight against Nichia and Nichia’s customer before the Shenzhen Intermediate Court (docket numbers: (2017) Yue 03 Min Chu 2283 and 2284) were terminated by Everlight’s withdrawal.
In addition, in January 2019, Nichia won infringement lawsuits based on YAG patent against Everlight and its distributors in China. The judgment has already became final, and Nichia received the damage compensation of RMB 3.2 million from Everlight and its distributors.
