Lawsuit with US major retailer
Last April, NICHIA CORPORATION filed a lawsuit alleging that certain white LED-application products marketed by Sharper Image Corporation and purchased from a third-party Asian manufacturer infringed NICHIA's U.S. patent (U.S. Patent No. 5,998,925). As part of the lawsuit, Nichia requested that Sharper Image discontinue marketing accused products containing these white LEDs. Sharper Image denied these allegations, but the parties have been able to amicably resolve their differences. As part of the resolution, Sharper Image and Nichia have agreed to enter into a business arrangement.
NICHIA gives serious consideration to the protection of its intellectual property and will vigorously enforce its intellectual property rights in any country. Likewise, as an intellectual property owner, Sharper Image maintains its commitment to respecting the intellectual property rights of others.
