Nichia files Patent Infringement Lawsuits against Harvatek and several Distributors in Germany

On September 8, 2010, Nichia Corporation (“Nichia”) filed a patent infringement lawsuit in Germany at the District Court Düsseldorf against a Taiwanese LED manufacturer, Harvatek Corporation (“Harvatek”), seeking an injunction, damages and recall. The service of complaint against Harvatek was done on November 9, 2010.

In this lawsuit, Nichia is seeking an injunction, damages and recall against two different white LED products (serial numbers HT-V116TW and HT-U158TW) manufactured by Harvatek, which Nichia believes infringe its patent (EP936682[DE69702929]).

On November 10, 2010, Nichia also filed patent infringement lawsuits in Germany at the District Court Düsseldorf against several German distributors selling the above mentioned Harvatek white LEDs, namely The Republic Group Handelsvertretung GmbH, MSC Microcomputers Systems Components Vertriebs GmbH, “Gleichmann & Co.” Electronics GmbH, Glyn Jones GmbH & Co. Vertrieb von elektronischen Bauelementen KG, Mouser Electronics, Inc., seeking an injunction, damages, recall and destruction. The service of these complaints has not been completed yet.

Nichia seeks to protect its patents and other intellectual property rights and takes actions against alleged infringers in any country where appropriate and necessary.
